By accessing the Website, creating an account, booking services, or participating in ranch activities, you agree to these Terms.
If you do not agree, do not use the Website or services.
1. Eligibility
You must be at least 18 years old to make bookings or purchases through the Website.
Parents or legal guardians may register or purchase on behalf of minors and accept responsibility for those minors.
2. Ranch Activities and Assumption of Risk
Equine activities, ranch activities, clinics, overnight boarding, and outdoor recreation involve inherent risks, including serious injury, illness, property damage, or death.
Participation is entirely voluntary.
By participating, you acknowledge and accept all inherent risks associated with ranch and equine activities.
Separate liability waivers may also be required before participation.
3. Bookings and Reservations
All bookings, reservations, and event registrations are subject to availability and approval.
Rocking Heart Ranch Ltd. reserves the right to:
- Refuse or cancel bookings
- Remove participants for unsafe, unlawful, abusive, or disruptive behavior
- Modify schedules, accommodations, instructors, or event details when necessary
4. Payments and Deposits
Certain bookings, clinics, or events may require non-refundable deposits, including standard clinic deposits of approximately $100 unless otherwise stated on the applicable booking page.
Specific cancellation and refund terms displayed on individual booking or event pages form part of these Terms.
Ride and Relax accommodations may generally be cancelled up to check-in time unless otherwise stated.
5. Overnight Boarding and Accommodations
Guests using RV sites, boarding facilities, or ranch accommodations agree to:
- Maintain safe and respectful conduct
- Follow all ranch rules and instructions
- Be responsible for damage caused by themselves, their guests, children, or animals
Rocking Heart Ranch Ltd. is not responsible for theft, loss, injury, illness, vehicle damage, livestock incidents, or property damage occurring on the premises except where required by law.
6. Horse Sales and Listings
Horse listings and sale information displayed on the Website are provided for informational purposes only.
Displaying horses or prices on the Website does not constitute a binding sales agreement.
All horse sales are subject to separate agreements and independent evaluation by buyers.
7. User Accounts
Users are responsible for maintaining the confidentiality of account credentials and for all activity occurring under their account.
We reserve the right to suspend or terminate accounts for misuse or violation of these Terms.
8. Website Use Restrictions
You agree not to:
- Use the Website unlawfully
- Attempt unauthorized access to systems or accounts
- Disrupt Website operations
- Submit false or misleading information
- Copy or reproduce Website content without permission
9. Intellectual Property

11. Limitation of Liability
To the fullest extent permitted by Alberta law, Rocking Heart Ranch Ltd., its owners, staff, contractors, and affiliates shall not be liable for:
- Indirect or consequential damages
- Loss of data, profits, or business opportunities
- Injuries or damages arising from participation in ranch or equine activities
- Website interruptions or technical failures
Total liability shall not exceed the amount paid by the customer for the applicable service or booking.
12. Indemnification
You agree to indemnify and hold harmless Rocking Heart Ranch Ltd. from claims, damages, losses, liabilities, and expenses arising from:
- Your use of the Website
- Your participation in activities
- Violation of these Terms
- Damage caused by you, your guests, animals, or minors under your supervision
13. Dispute Resolution
Any dispute arising from these Terms or the use of the Website shall first be addressed through good-faith mediation in Alberta, Canada.
If mediation is unsuccessful, disputes shall be resolved exclusively through the courts of Alberta.
14. Governing Law
These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.
15. Changes to Terms
We may update these Terms periodically. Continued use of the Website after updates constitutes acceptance of the revised Terms.
